Welcome to ColdLists.io! These Terms and Conditions (“Terms”) govern your use of our website (coldlists.io) and our subscription service, which provides 1000 mobile numbers monthly for £499 to sales teams for cold calling (“Service”). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree, please do not use our Service.

1. Our Service

1.1 What We Provide: ColdLists.io delivers 1000 mobile numbers monthly, tailored to your Ideal Customer Profile (ICP), for £499 per month per subscription. You’ll submit your ICP through our online form, and we’ll deliver the numbers as a CSV file via email within 5 business days.

1.2 Multiple Subscriptions: You may purchase more than one subscription to receive additional sets of 1000 mobile numbers tailored to different ICPs. Each subscription is treated separately for billing, delivery, and replacements, at £499 per month per subscription.

1.3 Replacements for Wrong Numbers: If a number is wrong (e.g., disconnected, incorrect contact, or unusable for cold calling, reported within 7 days), we’ll send you a replacement at no cost, up to 100 replacements per month per subscription.

1.4 Data Aggregation: We are a data aggregator, meaning we collect and organize data from external sources that have already obtained legal consent to collect and store the data. We do not maintain our own database of personal data and do not store your data after delivery.

2. Subscription and Termination

2.1 Subscription Term: Your subscription is month-to-month and automatically renews on your billing date unless you cancel.

2.2 How to Cancel: You can unsubscribe at any time by emailing us at support@coldlists.io. You’ll need to pay for any ongoing subscription period in full.

2.3 Our Right to Terminate: We may terminate your subscription by emailing you, with termination effective at the end of your current billing cycle.

2.4 Price Changes: We may revise our prices at any time, giving you at least one (1) month’s notice via email. New prices will apply when your subscription renews. If you don’t agree to the new prices, you can cancel as outlined above.

3. Payment

3.1 Fees: The Service costs £499 per month per subscription, payable in advance via credit card through a secure payment processor (e.g., Stripe). Stripe handles your bank details solely for payment purposes.

3.2 Late Payments: If your payment is overdue, you won’t receive your next list of mobile numbers until payment is made.

4. Your Responsibilities

4.1 Submitting Your ICP: You must submit your ICP via our online form within 3 days of starting your subscription, specifying your target region, industry, size, or other criteria.

4.2 Legal Compliance: You agree to use the mobile numbers in compliance with GDPR, TPS, and TCPA regulations, ensuring you have proper consent for cold calling.

5. Data Accuracy and Limitations

5.1 No Accuracy Guarantee: We do not guarantee the accuracy of the mobile numbers we provide. However, we’ll replace any numbers that aren’t correct (as defined in Section 1.3) at no cost.

5.2 Our Responsibility: If there are issues with the Service (e.g., incorrect numbers beyond replacements), our responsibility is limited to refunding the subscription fees you paid for that month. We’re not responsible for other costs, like lost sales opportunities.

6. Confidentiality

6.1 You agree not to share or resell the mobile number lists we provide to any third party.

7. Data Protection

7.1 Our Role: We comply with GDPR, TPS, and TCPA regulations by acting solely as a data aggregator, providing access to data that’s already publicly available or legally obtained by external sources. We do not store personal data and are not responsible for breaches of data protection laws by those sources.

7.2 Your Role: You’re responsible for ensuring your use of the data complies with applicable laws, including obtaining necessary consents for cold calling.

8. Governing Law

8.1 These Terms are governed by the laws of the United Kingdom. Any disputes will be resolved in the courts of England and Wales.

9. Force Majeure

9.1 We’re not liable for delays or failures due to events beyond our control (e.g., data provider outages, natural disasters).

10. Changes to These Terms

10.1 We may update these Terms at any time. Changes will be effective when we post them on coldlists.io or notify you via email. You’re responsible for checking these Terms periodically for updates.

11. Entire Agreement

11.1 These Terms, along with our Privacy Policy, make up the entire agreement between you and ColdLists.io. By using our Service, you confirm you’ve read, understood, and agreed to these Terms.
